Not open yet

Donations are not yet open. They will open only after TSP’s legal identity, the recipient of funds, these terms, the way the Fund is held and spent, and the applicable UK political-finance and payment-provider checks have been confirmed. Until then, no payment can be taken.

Section 01

What a donation is

The People’s Charter Movement Fund (‘the Fund’) is TSP’s donation fund. It runs alongside, and separately from, the Inner Circle subscription. TSP describes its purpose as follows:

Allows supporters of TSP and the People’s Charter Movement to contribute funds directly toward legal costs and the national campaign demanding a referendum for a codified constitution.

A donation is a one-off payment to the Fund. These terms apply between you and Legal entity name (to be confirmed) (‘TSP’, ‘we’, ‘us’), Legal form, registration number and registered address (to be confirmed), together with our Terms of Use and Privacy Policy.

  • Donations are made in pounds sterling (GBP).
  • You can choose one of the preset amounts (£5, £10, £20 or £50) or enter your own amount. No minimum or maximum amount is currently set. If we introduce any limit (for example, to comply with the law), we will publish it on this page before it applies.
  • Each donation is a single payment. Making a donation does not set up any recurring payment.
  • Donations are separate from Inner Circle membership. Making a donation does not make you a member, give you a membership number or give you access to members’ essays or the community.
  • Confirm: donors receive no goods, services or benefits in return (to be confirmed).

Donations are not yet open. No payment can be taken until TSP’s legal identity, the recipient of funds, these terms and the required checks are confirmed.

Section 02

How donations are used

Donations are used for the purposes of the Fund set out above: legal costs and the national campaign demanding a referendum for a codified constitution.

  • How the Fund is held: e.g. a separate, ring-fenced bank account, or held with TSP’s general funds (to be confirmed).
  • How money is divided between legal costs and the campaign: Allocation policy, or confirm that TSP decides case by case (to be confirmed).
  • What happens to money not needed for legal costs, or if a stated purpose can no longer be pursued: Policy for surplus or unused funds (to be confirmed).
  • What we tell donors about how the Fund is used, and how often: Reporting to donors, e.g. a published annual summary (to be confirmed).

Funds raised for ‘legal costs’ need a decision on how they are held and spent before donations open: for example, whether they are ring-fenced in a separate account or held on trust for the stated purpose, who decides how they are spent, what happens to any surplus or if the purpose ends, and how all of this is disclosed to donors. Money given for a stated purpose may have to be used only for that purpose; confirm the legal position and make sure the wording on this page and on the donation page matches how the Fund is actually run.

Do not describe specific legal proceedings, amounts raised or targets on the website unless TSP has confirmed them and they can be kept accurate.

Section 03

Not a charitable donation

TSP has not confirmed any charitable status. Donations to the Fund should not be treated as charitable donations.

  • You should not assume that Gift Aid applies to donations, and you should not make a Gift Aid declaration for them.
  • You should not treat a donation as tax-deductible. If you are unsure about your tax position, please take independent advice.

Section 04

Who can donate and permissibility checks

Depending on TSP’s legal status and the amount involved, the law may limit who TSP can accept donations from, and may require us to carry out checks and keep records. By making a donation, you confirm that:

  • you are at least Minimum age (to be confirmed);
  • you meet Eligibility requirements, e.g. UK electoral-register status or UK-registered company (to be confirmed);
  • Confirm: the money is your own and you are donating on your own behalf, not for another person or organisation (to be confirmed); and
  • the information you give us is accurate.

We may ask you for further information (for example, your full name and home address) to check whether we can accept your donation. If we cannot confirm that a donation is permissible, we will return it within Time limit for returning donations that cannot be accepted (to be confirmed). Where the law requires a donation to be dealt with in another way (for example, paid to the Electoral Commission), we will do so.

UK political-finance rules, including the Political Parties, Elections and Referendums Act 2000 (PPERA), may require TSP to check that donations come from permissible sources, keep records of donors, return or otherwise deal with donations it cannot accept within set time limits, and report donations above certain thresholds to the Electoral Commission, which may publish them. Which rules apply depends on TSP’s status (for example, a registered political party, a registered non-party campaigner, a referendum campaigner or none of these) and on the amounts involved, including repeat donations from the same person.

Because donors can enter their own amount and no maximum is currently set, confirm whether any limit or enhanced checks are needed for larger donations, how anonymous or unidentifiable donations will be handled, and whether Stripe’s acceptable-use requirements allow this type of payment. Donations will not open until this is confirmed.

Section 05

How payment works

Donations are processed by Stripe through Stripe Checkout, a secure payment page hosted by Stripe. You enter your card details directly with Stripe; they are never sent to or stored by TSP. Accepted payment methods: Accepted payment methods (to be confirmed).

The amount you choose is the amount you will be charged. Confirm: TSP adds no fees to donations, and how card-processing fees on donations are covered (to be confirmed)

Your donation is complete only once Stripe has confirmed the payment to us. If you leave checkout before paying, or the payment fails, no donation is taken. A confirmation page shown in your browser is not by itself confirmation that the payment has gone through.

Once your payment is confirmed, we will send a receipt to the email address you gave at checkout Receipt method: Stripe receipt or TSP email (to be confirmed). If you have a member account, the receipt will also be listed in your account.

Section 06

Records we keep

For each donation we keep a record of your name and email address, the amount, currency and date, the Stripe payment reference and status, and any information collected for permissibility checks. Donation records are kept separately from membership records.

We keep these records for Donation record retention period (proposed: six years) (to be confirmed), or for longer where the law requires.

Where UK political-finance law requires it, we may have to report donations (including the donor’s name, address and the amount) to the Electoral Commission, which may publish them Confirm whether any reporting obligations apply (to be confirmed).

Because donating to a political movement may reveal your political opinions, we treat these records as special category data. Our Privacy Policy explains how we use and protect them, and the rights you have.

Section 07

Mistakes and refunds

If you make a mistake (for example, you choose the wrong amount or donate twice by accident), please email enquiries@tspmedia.org.uk within Refund request window (to be confirmed) of the payment, giving the date, the amount and the payment reference from your receipt. We will look into it promptly and refund a donation made in error Refund terms for donations made in error (to be confirmed).

We will also refund or return any donation that we cannot lawfully accept (see ‘Who can donate and permissibility checks’).

Other refund requests: Refund policy for other requests, including once funds have been spent (to be confirmed).

Refunds are made to the original payment method through Stripe and may take Typical refund processing time (to be confirmed) to reach your account. If you think there is a problem with a payment, please contact us before raising a dispute with your card issuer, so that we can try to resolve it quickly. This does not affect your legal rights.

Legal reviewNeeds adviser sign-off

Confirm the refund policy for donations, including the time window for requests, and whether any statutory cancellation right applies to voluntary donations. Confirm also how refunds are reflected in any political-finance records or reports, and in the Fund’s accounts if it is ring-fenced.

Section 08

Recurring donations

We do not currently offer recurring (for example, monthly) donations. If we decide to offer them, we will do so only after their terms, including how to change or stop them, have been confirmed and published on this page. The Inner Circle subscription is separate and is covered by the Membership Terms.

Section 09

Changes and governing law

We may update these terms, for example to reflect changes in the law or in how donations work. The terms that apply to your donation are those published on this page when you make it. The current version will always be available here with its ‘last updated’ date.

These terms are governed by the law of England and Wales (to be confirmed). If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
